General terms and conditions of hire-in

These general terms and conditions of sale (hereinafter referred to as ” General Conditions “or ” the Contract ) are offered by SAS GLOBE ET CECIL HOTEL, registered in the LYON Trade and Companies Register under number 412 361 107, whose registered office is located at 21 Rue Gasparin, 69002 LYON (hereinafter referred to as “the Establishment”). the Establishment “).

ARTICLE 1: SCOPE OF APPLICATION

These Terms and Conditions apply to all purchases of Hotel Reservation services and related services (“the Services”). the Services “) offered by the Establishment to consumers (hereinafter indifferently ” the Customer “or “the Consumer “) via the Establishment’s website (” the Site “).

The main characteristics of the Services are presented on the Site. It is the Customer’s responsibility to read them before making a Reservation.

These Terms and Conditions govern only the sale of Services to consumers.

By accepting these General Terms and Conditions, the Customer acknowledges that he/she is a Consumer, i.e. a natural person acting for purposes that do not fall within the scope of his/her commercial, industrial, artisanal, liberal or agricultural activity.

These Terms and Conditions are accessible and printable at any time via a hypertext link available at the bottom of each page of the Site.

These General Terms and Conditions govern all the steps necessary for the Reservation and the follow-up of the Reservation between the contracting parties.

ARTICLE 2: ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE

To finalize the Reservation (” the Reservation “) and enter into this Contract, the Customer must have read and accepted these Terms and Conditions prior to the conclusion of the sale, i.e. the finalization of the Reservation on the Site.

In accordance with the provisions of article L.221-28, 12° of the French Consumer Code, the consumer unreservedly waives the right to exercise his or her right of withdrawal in respect of any order for the provision of accommodation services from the “Les Aubergistes Lyonnais” group or its partner hotels, where such services are provided for a specific date or period.

ARTICLE 3: PRICES, PAYMENT

Article 3.1 Prices

PRICE

All prices are indicated in Euros (€), all taxes included. The prices shown include the VAT applicable on the day of the order. Prices do not include tourist tax, which can be paid directly to the establishment.

These prices are valid during the validity period indicated. Prices are indicated before and at the time of the Reservation made by the Customer.

The prices issued are determined by a practice of fine-tuned price management. They may therefore depend on several parameters, such as (non-exhaustive list): the reservation date, the date of stay, the time between these two dates, and so on.

Prices are per room for the number of people and dates selected by the Customer.

In any event, any additional services booked and provided by the establishment to the customer during his stay must be paid for by the customer at the latest when returning the room, unless the service has been paid for in advance.

PRICE CHANGES

The prices of the Services will be those displayed on the Site at the time of validation of the Reservation by the Customer and for the dates selected by the Customer.

The prices displayed on the Site may change, but these changes will not affect any order confirmed by the Establishment in the order confirmation.

Article 3.2 Means of payment

The Customer may pay for the Services by card (Mastercard, Visa, American Express), and by other means that may be applicable in his country (cash: EUROS).

ARTICLE 4: RIGHT OF WITHDRAWAL

In accordance with article L.221-28 12° of the French Consumer Code, the Customer does not have the right of withdrawal as provided for in article L.221-18 of the French Consumer Code, if the Services are provided for a specific date or period.

The contract is therefore definitively concluded as soon as the Customer requests a Reservation in accordance with the terms and conditions specified in these General Terms and Conditions.

ARTICLE 5: COMMUNICATIONS AND COMPLAINTS

Any communications or notifications provided for under these General Terms and Conditions must be made by the Customer in writing to the following e-mail address :

ARTICLE 6: COLD CALLING

Pursuant to Article L.223-2 of the French Consumer Code, the Establishment reminds the Customer that he/she may register on the BLOCTEL telephone anti-solicitation list free of charge via the following link: https: //www.bloctel.gouv.fr/.

ARTICLE 7: INTELLECTUAL PROPERTY RIGHTS

The present General Conditions do not entail the transfer of any intellectual property rights to the Customer.

The Parties agree that ownership of the know-how and technology relating to the Services remains the exclusive property of the Vendor and consequently its use is permitted to the Customer only in connection with the performance of this Agreement.

The Seller is the owner of all intellectual property rights relating to any Service to be provided in the performance of the Contract.

Any reproduction, representation, modification, publication, adaptation of all or part of the trademark, logo, drawings, models, photographs, software, studies and prototypes of the Vendor or the holder of the intellectual property rights concerned, by whatever means or process and on whatever medium, and in general, any unauthorized use of the trademark or any of its elements, for other than personal and private use for non-commercial purposes, is prohibited, except with the prior written authorization of the Vendor or the holder of the intellectual property rights concerned, and may be prosecuted in accordance with the French Intellectual Property Code.

ARTICLE 8: APPLICABLE LAW AND JURISDICTION

Without prejudice to the mandatory legal rules of your place of residence, these General Terms and Conditions are governed by French law.

In the event of a dispute relating to the interpretation or execution of these General Terms and Conditions, the Customer is invited to contact the Etablissement’s customer service department as a matter of priority in order to find an amicable solution.

In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, the Customer may, before taking any legal action, have recourse free of charge to the mediation service for disputes relating to consumer rights. The competent mediator is La Médiation du Tourisme et du Voyage (MTV), which the Customer may contact as follows:

If the amicable procedure fails, the dispute will be referred to the competent court.
